PIPs Won't Save You: Performance Management and Labor Code Compliance in the Philippines

Performance management doesn't mean PIP-ing everyone. It means clarity.
Here's the pattern we see across Cebu, Manila, and Davao teams: companies build a performance management "process" the same week they're building a termination case. That's backwards, and it's expensive.
The Labor Code (Arts. 294–299) sets a high bar for just cause and due process. Two-notice rule. Documented opportunity to explain. A paper trail that has to survive scrutiny if it's ever challenged. Most PIPs we review weren't built for that bar — they were built after the decision was already made, as a formality to justify an exit.
That's not performance management. That's litigation prep wearing an HR costume.
Real performance management runs on a different clock:
→ Role clarity at hire — documented KPIs, not "figure it out as you go"
→ 90-day check-ins from day one, not month 11
→ Written feedback that exists whether or not someone underperforms
→ A file that shows growth attempts, not just gaps
This is where Aleph Talent Solutions and Hireyoo work as one system, not two vendors. Aleph runs the EoR and HR Retainer relationship on the ground in Cebu IT Park, Manila's BPO corridor, and Davao's services sector.
Hireyoo is the compliance-native vertical SaaS underneath it — performance management built around Philippine labor law from the ground up, not bolted on after. KPIs, check-ins, and feedback get logged as they happen, timestamped and structured to the same standard a two-notice rule expects. No reconstructing a file from memory after someone's already flagged for exit.
The result: employers running performance this way see measurably fewer disputes at NLRC and faster resolution when something does reach conciliation — because the record was built for accuracy, not assembled for defense.
Skip it, and you pay twice: the cost of the underperformer you should have managed out three months earlier, and the legal cost of doing it without the file to back it up.
Clarity is cheaper than either.
Aleph's people infrastructure, Hireyoo's compliance-native tech, one relationship, no gaps between them.
