Most foreign companies engaging Philippine contractors are exposed and don't know it. No compliant contract. No BIR withholding documentation. AOR — Agent of Record — is the structure that fixes this.
One line: AOR is for contractors. EOR is for employees. Everything else is detail.
What an AOR actually does: drafts a contractor agreement that survives a misclassification challenge, handles professional fee withholding and BIR Form 2307 issuance, verifies the contractor's compliance setup, and absorbs the misclassification risk. If the contractor ever files an illegal-dismissal case at the NLRC, the exposure sits with the AOR — not you.
Global platforms don't do this. They handle payment rails. They don't show up at the NLRC.
